“GROPPETTI AUTOMOTIVE $5G VIDEO CONTEST” OFFICIAL CONTEST RULES
The “Groppetti Automotive $5G Video Contest” (“Promotion”) starts on or about July 1, 2010 and ends on or about October 1, 2010. The Promotion is sponsored solely by Groppetti Automotive Family (“Sponsor”) located at 830 S Ben Maddox Way, Visalia, CA, 93292 and jointly administered by Groppetti Automotive Family, KGPE TV CBS47 located at 4880 North First Street Fresno, CA 93726 and KSEE Television Inc. located at 5035 E. McKinley Ave., Fresno, CA 93727. As the sole sponsor of the “Groppetti Automotive $5G Video Contest” (“Promotion”), Groppetti Automotive Family holds harmless the other administrators of the contest.
ELIGIBILITY: The Promotion is open only to legal residents of Central San Joaquin Valley DMA (which includes the counties of Fresno, Madera, Modesto, Merced, Tulare and Mariposa) that are 18 years of age or older at the time of entry (“Eligible Contestants”). Sponsor’s employees, its parent companies, affiliates, subsidiaries, advertising, promotion and production agencies, and their employee’s immediate family members (spouses, siblings, parents, children, grandparents and grandchildren, whether as “in-laws”, or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension) and persons living in the same household of each, are not eligible to enter. Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law.
HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. A Purchase will not improve your chance of winning.
To Enter, (1) Read and agree to the Official Contest Rules posted at www.groppettiauto.com, CBS47.tv and KSEE24.com and available at any of the aforementioned Sponsor and Administrator(s) locations during their respective normal business hours; (2) Create a Commercial for any one of the Groppetti Automotive Family Dealerships- specific details on how to create the video below; and (3) Submit your video online by 11:59 PM PST on August 29, 2010 to CBS47.tv and/or KSEE24.com using the “Groppetti Automotive $5G Video Contest ” contest links under the following parameters and restrictions:
a) Video submissions may not exceed two (2) minutes in duration.
b) At least one mention of Groppetti Automotive or the Groppetti Automotive Family must be made in the video and that one of the following dealerships must be mentioned at least once Nissan of Visalia, Visalia Toyota, Visalia Honda, Visalia Ford, Visalia Hyundai, Visalia Buick-GMC or GA Motorsports
c) Entrants must be the original creator and owner of the video.
d) Video submissions may not include any material that violate or infringe upon the patent, copyright, literary, privacy, publicity, trademark, service mark or any other personal or property right of any person, nor will same constitute a libel or defamation of any person or entity, nor will same constitute obscene, indecent or pornographic material, as determined by Sponsor.
e) Video submissions must comply with all laws and regulations.
f) By submitting a video, entrant acknowledges that he/she secured the requisite consent from any third party referenced or appearing in the video entry.
g) Only one video entry per person will be accepted.
h) Video submissions may not contain nudity, foul language, derogatory comments about any Groppetti Automotive Family Dealership or staff or otherwise offensive content is allowed.
Entrants agree to be bound by the terms of these official contest rules and eligibility criteria, and by the decision of Groppetti Automotive Family - which is final and binding on all matters pertaining to this video contest.
Based on the eligible video submissions made by Contestants, the public will be asked to judge the entries on the following three criteria: most creative, effective and memorable.
WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY COMPUTERIZED SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGE FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
All entries and submissions become the property of Sponsor, and Sponsor reserves the right to use any information submitted by entrants. Sponsor is not responsible for lost, late, illegible, misdirected or mutilated entries or submissions, including due to technical/network failures, human error, or any other error or malfunction. Entry materials that have been tampered with or altered are void.
The authorized account holder of the e-mail address submitted at time of entry will be considered the entrant. An “authorized account holder” shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. A potential winner may be requested to provide proof that he or she is the authorized account holder of the e-mail address associated with a winning entry.
Entrants agree not to upload, post or transmit any materials which contain any computer viruses, Easter eggs, worms, Trojan Horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. Any attempt to deliberately damage any web site or undermine the operation of the Contest is a violation of criminal and civil laws, and Sponsor reserves the right to seek damages from any person who makes such attempt(s).
PRIZES: The Grand Prize Winner will receive Five Thousand Dollars ($5,000.00) cash and featured on KGPE TV CBS47 and KSEE24 Television.
Groppetti Automotive Family reserves the right to substitute, add or change prizes prior to the contest period with prizes of comparable value. All prizes are subject to the rules of the prize donor. All applicable taxes including federal and state income tax are the sole responsibility of the Winner and may be reported for tax purposes as required by law. The winner is solely responsible for reporting and paying any and all applicable taxes related to the prize and paying any expenses associated with any prize which is not specifically provided for in the official rules. Each winner must provide the Sponsor with valid identification and a valid taxpayer identification number or social security number before prize will be awarded. Any person winning over $600 in prizes from the Sponsor will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. The Prizes may not be sold or transferred. NO PURCHASE NECESSARY TO ENTER OR WIN.
CONDUCT and DECISIONS: By participating in the Contest, participants agree to be bound by the decisions of Company personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules of the Contest and the Sponsor’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Sponsor, the Sponsor reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Sponsor deems appropriate. All decisions will be made by the Sponsor are final. The Sponsor may waive any of these rules in its sole discretion.
WINNER SELECTION: The contest period will be divided into three (3) separate and distinct periods: Submission Period 7/1/2010 to 8/29/2010, the Preliminary Voting Period 8/30/2010 to 9/10/2010 and the Finalist Voting Period from 9/13/2010 to 9/26/2010. SUBMISSION PERIOD: Eligible Contestants are encouraged to create their own Groppetti Automotive Family commercial within the aforementioned parameters and enter the contest through online submission to either CBS47.tv or KSEE24.com. PRELIMINARY VOTING PERIOD: Public is encouraged to vote for the submission they believe is the most creative, effective and memorable commercial on CBS47.tv or KSEE24.com. The five (5) entrants with the most votes on CBS47.tv and KSEE24.com will be posted on each television stations’ respective websites and will be considered the 10 Finalists. FINALIST VOTING PERIOD: The same top 10 Finalists will be posted on CBS47.tv and KSEE24.com and the public will be encouraged to vote for the one user generated Groppetti Automotive Family commercial contest submission that they believe is the most creative, effective and memorable. Only one vote per person per television station website will be allowed. The Finalist with the most cumulative votes will be awarded the Grand Prize on or about 10/1/2010.
AFFIDAVITS: Except where prohibited by law, prize acceptance constitutes permission to use Winner's name, address, images and/or likeness for purposes of advertising and promotion in any media, including on-line worldwide, without limitation or further compensation.
RELEASES AND GENERAL CONDITIONS: By entering the Promotion, participants: (a) grant the right, but not the obligation to Groppetti Automotive Family and affiliated companies, KGPE CBS47 and KSEE NBC24, its agents and assigns, to use the name, voice and/or simulation thereof, and/or any portion of the undersigned individual or individual with others, on (Video tape) (Film) (Internet) (Photograph) (Audio tape) in, and in connection with promotional or commercial announcements, news or entertainment programming. Furthermore, Groppetti Automotive Family and affiliated companies, KGPE and KSEE may use and re-use the above material in perpetuity, without restriction to the number and type of uses, and without compensation of any kind, and (b) agree that by submitting an entry, they irrevocably authorize Sponsor and its designees to use and broadcast his or her name on the air without compensation or breach of any rights of publicity under the law (c) to be bound by the Official Rules, (d) all decisions of the Sponsor shall be final and binding, and (e) that the Sponsor, its parent and affiliate companies, their advertising or promotional agencies, and their respective officers, directors, attorneys, agents, and employees are not responsible for and shall not be liable for (1) any design, printing, typographical, or other errors, omissions, deletions, or defects, in any material associated with the prizes or Promotion; (2) illegible, incomplete, damaged, misdirected, late, lost, postage due, undelivered, or unprocessed entries and all other matters associated with on-line entries. PRIVACY: Sponsor will be collecting personal data about Promotion’ entrants through Entry Forms, in accordance with its privacy polices.
